TERMS AND CONDITIONS FOR THE RESERVATION OF LODGING SERVICES

  1. INTRODUCTION

This document regulates the general terms and conditions of contracting online accommodation bookings through www.gruporoisa.com ("Website") of Origen Habacu, S.L., Calle San Bernardo 87 28015 Madrid, CIF: B86917531 (hereinafter, "Grupo Roisa").

The particular terms and conditions that may be applicable are made available to the Client before the reservation is formalized.

Notwithstanding the foregoing, please note that these terms and conditions apply to any type of accommodation reservation made with Grupo Roisa through any means, including telephone, face-to-face sales, etc.

  1. BOOKING CONDITIONS AND PRICE

When the Client makes a reservation, he/she must take into account that at least one person over 18 years of age is required per reservation.

At the time of booking it is necessary that the Client informs Grupo Roisa of the number of guests to be accommodated as this circumstance will determine the type and rate of the room or apartment. The Client must take into account that children over 2 years old are charged the same rate as an adult.

When the Client makes a reservation through the Web Site, the rates indicated in the search results are the applicable rates. All rates are for rooms or complete apartments. In the event that once the reservation is formalized, an additional adult is subsequently requested to the reservation, Grupo Roisa may make available to the same, if and when possible, an extra bed in the apartment booked with an additional cost of 20 euros per person per day.

The price indicated prior to acceptance of these Terms and Conditions and payment of the reservation, i.e. before the Customer is bound by any contract or payment obligation, is final and complete and includes the price of all products selected and all applicable taxes.

In the event of any unforeseen changes or problems with the reservation, Grupo Roisa will automatically contact the Client for approval/instructions before making any changes to the reservation.

The price does not include any unspecified services and extras such as telephone calls, transfers, parking, etc.

Grupo Roisa reserves the right to charge a security deposit of 150€ per apartment in Roisa Centro as informed at the time of booking, to cover possible damages in case they occur. This deposit will be returned if the apartment is in perfect condition and no incidents have occurred.

  1. CONFIRMATION OF RESERVATION

The contract signed between the Client and Grupo Roisa will come into force at the moment that Grupo Roisa provides written confirmation of the reservation to the Client by e-mail.

Therefore, after making a reservation, the Client will receive a confirmation e-mail, which will also include the payment conditions, the cancellation policy, the apartment address, our telephone numbers and all the necessary and useful information of your reservation.

  1. CANCELLATION OF RESERVATION
    • Standard rate: the Client may cancel his reservation up to 2 days before the date of arrival free of charge. After this period, in case of cancellation, the total amount of the stay will be charged.
  • Promotional rates: are non-refundable and non-modifiable in any case.

The Customer can consult the cancellation conditions applicable to his reservation in the confirmation e-mail.

To cancel your reservation, please contact us in writing, by e-mail, or by telephone. You can consult our contact details on the Web Site.

  1. NO-SHOW

If the Client does not show up at the apartment on the scheduled date of arrival, without prior cancellation, Grupo Roisa will always charge 100% of the stay.

  1. MODIFICATION OF THE RESERVATION
    • Modification of the reservation by the customer

In the case of standard rates, the Client can modify his reservation, subject to availability, up to 2 days before the date of arrival. If the new selected date has a higher price, the customer has to pay the difference. After this period, in case of changes, the total amount of the reservation will be charged.

Promotional rates are non-exchangeable and non-refundable.

You can contact us by email or telephone with any modifications you may require such as adding nights to your reservation, number of people or changing the type of apartment. You can check our contact details on the Web Site.

Please note that if you need extra nights it will depend on the availability at that time.

If you wish to reduce the number of nights booked, you may be subject to a cancellation fee, but we will always do our best to assist you.

  • Modification of the reservation during the stay by the Client

If the Client wishes to shorten his stay and leave the rooms or apartments before the scheduled date of the end of his stay, Grupo Roisa will not refund the amount of the remaining nights.

If the Client wishes to extend his/her stay, he/she should contact Grupo Roisa as soon as possible to confirm availability and the applicable rate.

  • Modification of the reservation by Grupo Roisa

In the event that Grupo Roisa, due to force majeure or unforeseen circumstances, should have to modify a reservation, this will be notified immediately by email or telephone to the Client. Grupo Roisa will offer, whenever possible, a room or apartment with the same characteristics as the one reserved.

If the Client does not agree with the proposed alternative, he/she may cancel the reservation without being subject to the cancellation policy, receiving the amount paid so far. In this case Grupo Roisa does not assume any other responsibility for the total or partial cancellation of the reservation.

  1. PAYMENT METHOD

In the case of non-refundable reservations, the total amount will be charged to your credit card at the time of booking. In the case of refundable reservations, the price of the first night will be charged and the rest at the time of your arrival at the apartment.

Payments can be made in cash, by credit/debit card (Visa, MasterCard or American Express) or by bank transfer. In case of bank transfer please note that your bank may charge a commission for an international transfer.

If payment is made by bank transfer, please note that the reservation will not be confirmed until we receive the transfer receipt by e-mail and the reservation will be subject to confirmation of the deposit, which must have been made at least 3 days in advance, in the case of national transfers, and at least 15 days in advance for international transfers.

  1. EXCLUSION OF THE RIGHT OF WITHDRAWAL

We inform you that the right of withdrawal for distance contracting provided for in Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, is excluded, among others, in service contracts for the provision of accommodation services. Therefore, the right of withdrawal does not apply to accommodation services provided by Grupo Roisa.

  1. LODGING AND ACCOMMODATION RULES

The following describes the rules of accommodation and stay of Grupo Roisa. If the Client or any of the guests or companions fail to comply with any of the rules detailed herein, Grupo Roisa reserves the right to unilaterally and under its own criteria request the Client to leave the accommodation, without in any case be entitled to compensation or compensation by Grupo Roisa.

  • Arrival/Departure

Arrival: The room or apartment will be available from 15:00h. If for any reason you arrive before this time, please inform Grupo Roisa and we will try to receive you in advance whenever possible.

Please note that in Roisa Centro, for arrivals between 22:00h and 00:00h, there is an additional cost of 20,00€ that will be paid, together with your accommodation, to the person responsible for your reception. In case of arrivals between 22:00h and 00:00h it is essential that you inform Grupo Roisa by email. WE DO NOT ACCEPT SCHEDULE COMMUNICATIONS, CHANGES OR CANCELLATIONS BY PHONE.

Please note that NO ARRIVALS AFTER 00.00h are allowed.

Check-out: Check-out must be before 11:30h, in case you want to leave later, please check availability at the time of your arrival or before your departure date. Upon request and subject to availability, you can stay in the apartment until 13:00h with an additional cost of 20,00€ per room or apartment (except for Club Roisa Gold Clients, where it is free of charge). For departures after 13:00h will be charged as an additional day of stay.

  • Identification

At the moment of arrival at the Roisa Group accommodation, it is essential that the Client and all guests identify themselves with their ID card.

Likewise, in the case of card payments, the Client must present the same bank card used for the reservation together with the ID of the card holder. In case of not being the cardholder, he/she must present an authorization together with a photocopy of the cardholder.

  • Number of guests

The number of persons per apartment cannot exceed the maximum number of persons included in the reservation, except in the case of children under 2 years of age. Baby cribs are available upon request at no additional cost.

In the event that Grupo Roisa detects that the number of guests exceeds the number of people included in the reservation, 20 euros/night will be charged for each additional guest.

  • Pets

Pets are not allowed except in cases where Roisa Group expressly authorizes it. In these special cases the Client must contact Grupo Roisa by email to process this authorization, which must be approved in advance. In the event that the authorization to accommodate pets is granted, an additional cost of 20 euros per reservation and per night will be charged to the Client.

  • Cleaning

The Client undertakes to maintain the furniture and all the contents of the apartment or room in the same condition in which it was found upon arrival.

At the end of the stay the Client is obliged to leave the apartment in a reasonable condition. Otherwise, an additional cleaning fee of 20 euros will be charged.

  • Behavior

Loud music and parties are strictly forbidden. Rest hours are from 22:00h to 09:00h and must be respected.

When booking an apartment the Client must know that, if any kind of scandal or loud music is heard and the neighbors complain to Grupo Roisa and/or call the police, this type of event may result in an immediate eviction regardless of the time of day or night. In the event that the neighbors or the police call the emergency number of Grupo Roisa, the Client must pay 150€, acting as a guarantee the card provided at the time of booking or the deposit paid at the time of booking.

We thank you for your understanding and cooperation in this matter and hope that you understand that these rules are necessary for a coexistence based on respect.

We expect a civic and correct behavior on the part of the Client and all persons accompanying him/her. If any of the guests does not behave in an appropriate and responsible manner, Grupo Roisa reserves the right to ask the client and his companions to leave the apartment immediately, without the right to future claims or any type of compensation. This will result in the loss of the remaining accommodation and, if applicable, of the deposit.

  • Furnishings and cleaning

The Client undertakes to maintain the furniture and all the contents of the apartment or room in the same condition in which it was found upon arrival.

Grupo Roisa will have the right to demand compensation from those clients who do not comply with the cleaning criteria, or who cause damage to the furniture due to improper use (minimum 50€); acting as a guarantee the credit card provided in the reservation or the amount paid as a deposit.

We expect a civic and correct behavior from you and from all the people accompanying you.

Grupo Roisa reserves the right to request at the time of arrival a deposit of 150€ per apartment, to cover possible damages in case they occur. Grupo Roisa may block the amount of the deposit on the Client's credit card or, in the event that the Client does not have a credit card, the payment will be made in cash. In the event that the Client does not pay the requested deposit, Grupo Roisa reserves the right to prohibit the Client and/or guests from entering the apartment. This deposit will be returned at the time of departure if the apartment is in perfect condition and no incidents have occurred.

  • Key handover

In Roisa Centro the client must leave the keys at the reception of the apartments or in the mailbox on the first floor (if leaving before 11:00).

Loss of keys will incur a charge of 50€.

Additionally in Roisa Centro, if the staff has to move out of the established reception hours (12:00h to 21:00h) for reasons beyond the control of Grupo Roisa as a result of misuse of the apartment by the Client, forgetfulness, loss of keys or negligence, the Client will have to pay a cost of 25 euros.

  • Smoking is prohibited.

By law it is strictly forbidden to smoke in the apartments (including on the balconies). In case of detecting that the customer has smoked in the accommodation, the penalty is 90 € and will be charged to the customer's credit card.

  1. ROISA GROUP RESPONSIBILITY

Grupo Roisa is not responsible for any direct or indirect damage that may occur as a result of the client's misuse of the apartment, including, without limit of damages, losses due to fire, theft or criminal behavior. In case of any infringement, Grupo Roisa, at its own discretion, will have the right to ask the client to leave the apartment and, will charge the client, by means of his bank card or in cash, the amount equivalent to the broken or deteriorated materials, condition that the client expressly accepts herewith,

  1. PRIVACY POLICY

Grupo Roisa recognizes the importance of protecting the personal information of its users and customers and to keep it confidential and secure in accordance with current regulations.

This privacy policy describes the processing of data of our users and customers collected through www.gruporoisa.com ("Website"), by telephone or any other communication channel, so we recommend our users and customers to read carefully this privacy policy to provide Roisa Group personal data that may require them fully informed in particular on the mandatory nature of the delivery of data and the purpose of their treatment.

We also inform you that in the future modifications may be made to this privacy policy in order to ensure constant respect for the applicable regulations and to adapt it to new legislation or jurisprudence.

  • Responsible for the treatment

Personal data will be processed automatically and/or manually and incorporated into the file owned by Origen Habacu, S.L., Calle San Bernardo 87 28015 Madrid, CIF: B86917531 (hereinafter "Grupo Roisa" or "The Data Controller").

 

  • Collection and purpose of personal data processing

In accordance with Law 15/1999 on the Protection of Personal Data ("LOPD") and its implementing regulation R.D. 1720/2007 ("RDLOPD"), we inform our users and customers that their personal data are collected, stored and processed automatically and/or manually by Grupo Roisa in the manner and for the purposes described below and in accordance with the provisions of the LOPD and the RDLOPD.

Grupo Roisa may collect data from users and customers:

- Directly from the user because he provides his data directly and telematically by filling in any form available on the www.gruporoisa.com ("Website") or by telephone for the provision of the service requested by the user.

- By means of computer systems and software procedures incorporated in the Website for its correct functioning: The processing of personal data of the user who visits and consults the Website is limited to the so-called 'navigation data', that is, those data that are necessarily transmitted to the Website by the action of the computer systems in charge of its administration and of the communication protocols of the Internet. Collection, storage and processing of data for the purpose of establishment and operational and administrative management of the contractual relationship connected with the provision of the Roisa Group Service, including the use of such data for sending communications relating to the development of the contracted service via email, SMS or any other means of communication.
  2. Compliance with legal obligations.
  3. Sending commercial communications via email or other equivalent means of electronic communication, about products or services similar or related to those offered by Grupo Roisa in the terms provided in Art. 21 of Law 34/2002 of services of the information society. Occasionally, these commercial communications may be sent in a personalized way.
  4. Sending of "The best offers": without prejudice to the provisions of the previous section, and only with the express consent of the user, Grupo Roisa will process the data for sending via email, telephone, postal mail, SMS, MMS or any equivalent means of communication, the best offers on any type of product and service marketed by Grupo Roisa or by its partners or commercial collaborators operating in the following sectors: tourism, leisure and catering, events, sport, music, fashion, clothing, clothing, textile decoration, consumer goods, food and beverages, finance, energy, media, new technologies, telecommunications, publishing and publishing houses, environment, retail and services in general.

Users and/or customers may exercise their rights of access, rectification, cancellation provided for in the Organic Law 15/1999, of December 13, 1999, on the Protection of Personal Data and other applicable regulations to that effect, by contacting Grupo Roisa attaching a copy of the ID card by writing to the e-mail address info@gruporoisa.com or to the address Calle San Bernardo 87, 28015. Additionally, if users and/or customers do not wish to receive commercial or promotional offers by email from Grupo Roisa, in addition to exercising the rights indicated above, they can revoke their consent by sending an email to info@gruporoisa.com indicating in the "Subject" field the word "Unsubscribe".

 

  1. APPLICABLE LAW AND JURISDICTION
  • If the Customer is a professional or company

These General Terms and Conditions are governed, to the extent permitted by applicable law, by Spanish law. Also, to the extent permitted by applicable law and international agreements, the parties agree to submit to the jurisdiction of the Courts of Madrid, Spain, for any matter relating to the interpretation, compliance or enforcement of these Terms and Conditions, expressly waiving any jurisdiction that may correspond to them, provided that the applicable law does not establish a specific mandatory jurisdiction.

 

  • If the Customer is a consumer

These General Conditions are governed by Spanish law or, if you reside outside Spain, by the law of the country of your residence.

Any controversy in relation to these General Conditions shall be submitted to the jurisdiction of the place of residence of the Customer, and, in the event that this jurisdiction is not mandatory by law, at the option of the Customer, that of his residence or that of the domicile of the Roisa Group.

We inform you that you can use the online dispute resolution platform for services provided by European Union companies (the "ODR Platform"), which the European Commission makes available to all its citizens at the following link http://ec.europa.eu/consumers/odr/.

Therefore, consumers in the European Union may send their complaints to ORIGEN HABACU S.L. (Grupo Roisa) through the ODR Platform using the e-mail address of Grupo Roisa.

We inform you that you can use this email address only for the purpose of sending us your complaint through the ODR Platform. Therefore, any email you send to info@gruporoisa.com outside the procedure established through the ODR Platform may not be answered.

 

  1. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed, to the extent permitted by applicable law, by Spanish law. Also, to the extent permitted by applicable law and international agreements, the parties agree to submit to the jurisdiction of the Courts of Madrid, Spain, for any matter relating to the interpretation, compliance or enforcement of these Terms and Conditions, expressly waiving any jurisdiction that may correspond to them, provided that the applicable law does not establish a specific mandatory jurisdiction.
